HS Code Misclassification — On-the-Ground Risks and Practical Challenges in Customs Clearance

In Japan’s trade operations, misclassification of HS codes occurs more frequently than one might expect.

For example, an electronics manufacturer once determined the HS code for a new product import declaration by referring to past data of similar items. However, the actual product specifications differed slightly, and the declared tariff rate was later found to be incorrect, resulting in additional duties. This case not only caused delays in customs clearance but also disrupted the logistics schedule.

The main causes of HS code misclassification can be summarized into the following three points:

1️⃣ Vague or unclear product descriptions When product names or specifications are ambiguous, it becomes difficult to determine the appropriate classification.

2️⃣ Multi-functional products If a product has multiple functions, the HS code may vary depending on which function is prioritized for classification.

3️⃣ Over-reliance on past declarations or personal experience Simply referencing previously used codes may not be suitable for new or modified products, creating a breeding ground for misclassification.

As a result, declaration amendments and customs delays may occur, affecting delivery timelines and logistics planning. Moreover, repeated misclassification can negatively impact a company’s credibility.

Companies should not treat HS code classification as a mere administrative task. Instead, it should be managed systematically from a risk management perspective.

Practical countermeasures include establishing standardized internal classification rules, clarifying product descriptions, and implementing risk checklists for each new product rather than relying solely on past declarations.

In this post, we focused on the causes and impacts of HS code misclassification. In the next post, we will explore another common issue in customs clearance—how inconsistencies in documentation can lead to shipment holds or delays, illustrated with practical examples.
